Introduction

The mandatory disciplinary, dismissal and grievance procedures have been repealed – but has it made much of a difference?

The event in detail

It is now an unfair dismissal (with a 1-25% uplift) to fail to follow the ACAS Code on Discipline and Grievance Procedures. The ACAS Code contains a disciplinary procedure similar to the statutory one, but the grievance procedure has changed, with the loss of the post employment grievance. There are no specified procedures for non-disciplinary dismissals such as redundancy and sickness.
This workshop will look at the changes introduced by the Code and its supporting guidance notes as well as procedures for non-disciplinary dismissals.
